Right of Withdrawal (Widerruf)
Consumers have a right of withdrawal under the following conditions. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession.
Right of Withdrawal
You have the right to withdraw from this contract within 14 days without giving any reason.
The withdrawal period is 14 days from the day you receive the goods.
To exercise the right of withdrawal, you must inform me (Dustin Roesler, Kulmgasse 44/6, 1170 Wien, Austria, support@hootcollect.eu) of your decision to withdraw from the contract by a clear statement (via email).
Sending the notice before the 14-day period ends is sufficient.
Effects of Withdrawal
If you withdraw from this contract, I will refund all payments received from you (including standard shipping costs) within 14 days from the day your withdrawal notice is received.
The refund will be made using the same payment method you used.
I may withhold the refund until I have received the returned goods or until you provide proof of return.
You must send back the goods within 14 days of informing me of the withdrawal.
You bear the direct cost of returning the goods.
You are responsible for any loss in value of the goods caused by handling that was not necessary to check the condition, quality or functioning of the item.
Exclusions
The right of withdrawal does not apply to:
- Sealed TCG products once the seal has been broken (e.g. sealed boxes, displays, tins).
- Customized or specifically requested card bundles (e.g. custom lots, requested playsets).
- Digital items, if applicable.
Compensation for Loss of Value After Opening Booster Packs
In this case, claims for compensation for loss of value apply according to Section 18 (4) of the Austrian Distance and Off-Premises Contracts Act (FAGG).
The reasoning is that opening a trading card booster pack is not necessary to examine the condition, characteristics, or functioning of the product.
To verify compliance with the contract, an external inspection in unopened condition is sufficient.
The loss in value is calculated as the difference between the purchase price of the sealed booster and the total market value of the individual cards returned.
Exclusion of the Right of Withdrawal for Non-EU Consumers
The right of withdrawal does not apply to consumers who, at the time of concluding the contract, do not belong to a Member State of the European Union and whose sole residence and shipping address at that time are located outside the European Union.
General Information
- Please avoid damaging or contaminating the goods.
- If possible, return the item in its original packaging, including all accessories and packaging components.
- Use protective outer packaging if necessary.
- If the original packaging is no longer available, please ensure adequate protection against transport damage.
- Please do not return goods freight collect (freight collect / cash-on-delivery returns).
Please note that the points above are not required for the valid exercise of your right of withdrawal.
