Terms and Conditions (T&C)

1. General
- 1.1 These Terms and Conditions ("T&C") apply to all orders, sales and deliveries of products ("Products") offered and sold via this webshop ("Webshop") on the website https://hootcollect.eu.
- 1.2 The contract language is English.
2. Scope
- 2.1 These T&C apply where the purchaser is a consumer within the meaning of § 1 of the Austrian Consumer Protection Act (KSchG) ("Customer").
3. Changes to the T&C
- 3.1 The Seller reserves the right to amend these T&C. The version valid at the time of purchase shall apply.
4. Customer Account
- 4.1 The Customer may create an account to place orders. Providing certain personal data is required. Orders can also be placed without creating an account.
5. Orders, Order Confirmation, Acceptance
- 5.1 The ordering process includes: • Selecting products • Adding products to cart • Entering personal details • Selecting payment and shipping method • Reviewing and correcting the order • Submitting the order via "order with obligation to pay"
- 5.2 All product displays and prices in the Webshop constitute a non-binding invitation to place an order. By placing an order, the Customer submits a binding offer. Product images are illustrative. Minor deviations are acceptable.
- 5.3 The Customer will receive an order confirmation email. This does not constitute acceptance.
- 5.4 The contract is concluded by: sending an order confirmation, dispatch of goods, or a payment request.
- 5.5 The Customer must provide accurate and up-to-date information.
- 5.6 Invoices are issued electronically. The Customer agrees to this.
6. Pricing and Payment
- 6.1 All prices are in EUR including VAT, excluding shipping unless stated otherwise.
- 6.2 Available payment methods include: Credit Card, Apple Pay, PayPal, Klarna, Google Pay, EPS and similar services.
- 6.3 Shipping costs are displayed before checkout.
7. Delivery
- 7.1 Shipping methods are shown in the Webshop.
- 7.2 Delivery time is up to 30 days unless otherwise stated.
- 7.3 Delays due to force majeure extend delivery times accordingly.
- 7.4 We can combine shipping for multiple orders. However, this must be requested before any part of the order has been packed or shipped. Shipping is carried out exclusively via GLS, depending on the selected shipping method.
- 7.5 Preordered items are shipped once they become available. Release dates may change and delays can occur. Orders containing preorder items will generally be shipped only when all items are available, unless agreed otherwise. We reserve the right to cancel preorders in case of supplier shortages, allocation issues or pricing errors.
8. Retention of Title
- 8.1 Ownership remains with the Seller until full payment is received.
9. Delay of Seller
- 9.1 If the Seller is in delay, the Customer must grant a reasonable grace period before withdrawing from the contract.
10. Warranty
- 10.1 Statutory warranty rights apply. For complaints, please contact support@hootcollect.eu.
11. Liability
- 11.1 Liability for slight negligence is excluded except in cases of personal injury or essential contractual obligations. Liability for indirect damages, loss of profit, third-party damages and consequential damages is excluded, unless caused by gross negligence or intent.
12. Applicable Law
- 12.1 Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
13. General Product Information
- 13.1 Bulk cards graded as Near Mint are NM or better, Excellent as EX or better, etc.
- 13.2 Minor imperfections may occur due to manufacturing or handling.
14. Orders and Preorders
- 14.1 We reserve the right to cancel orders or preorders in whole or in part for reasons including inventory errors, incorrect pricing, supplier issues, grading discrepancies or market conditions.
15. Shipping
- 15.1 Shipping is handled via GLS.
- 15.2 Delivery times are estimates and not guaranteed.
- 15.3 Risk passes to the customer upon delivery, unless otherwise required by law.
16. Selling Cards to Us
- 16.1 Non-Binding Submission Submitting cards through our "Sell Your Cards" form does not constitute a binding offer or contract. Any preliminary price indication is non-binding.
- 16.2 Inspection and Final Offer A binding purchase offer will only be made after the cards have been received and inspected. The final offer may differ depending on condition, authenticity and completeness.
- 16.3 Shipping A prepaid shipping label may be provided as a convenience. The risk of loss or damage during transit remains with the sender until received.
- 16.4 Packaging Responsibility The sender is responsible for secure packaging. No liability is assumed for damage due to insufficient packaging.
- 16.5 Condition Discrepancies If the condition differs from the description, the offer may be adjusted or withdrawn.
- 16.6 Rejection and Return If the offer is declined, cards may be returned upon request. Return shipping costs are borne by the sender.
- 16.7 No Obligation to Purchase There is no obligation to purchase submitted items.
- 16.8 Payment Payment is made only after acceptance of the final offer.
